3. Pricing and Payment

One-time Setup Fees: Due upon agreement to proceed with work
Monthly Services: Billed monthly in advance via credit card or ACH
Refunds: Setup fees are non-refundable once work has commenced. Monthly services can be cancelled with 30 days notice.
Late Payments: Accounts 15+ days past due may have services suspended

4. SMS Communications

By opting in to SMS communications:

You agree to receive text messages from AI Smart Scaler at the phone number you provided
Message frequency varies (typically 1-5 messages per week)
Standard message and data rates may apply from your mobile carrier
You may opt out at any time by replying STOP to any message

5. Client Responsibilities

As a client, you agree to:

Provide accurate information about your business
Own or have rights to all content provided for use on your website
Respond to our communication in a timely manner
Pay all fees on time
Comply with applicable laws and regulations

6. Intellectual Property

Upon full payment, you own the final deliverables for your website. AI Smart Scaler retains ownership of proprietary tools, templates, and processes used to create deliverables. We may use non-confidential details of your project in our portfolio.

7. Free Demo Disclaimer

Free demo websites are provided for evaluation purposes only. Demos remain the property of AI Smart Scaler until you engage us for full service and pay the required fees. We may remove demo sites at any time if not converted to paid engagement.

8. Service Availability

We strive for 99.9% uptime for hosted websites. However, we do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible.

9. Limitation of Liability

AI Smart Scaler shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Warranty Disclaimer

Our services are provided "as is" without warranties of any kind, express or implied. We do not guarantee specific business results, search engine rankings, or revenue outcomes.

11. Termination

Either party may terminate the service agreement with 30 days written notice. AI Smart Scaler may terminate immediately for:

Non-payment
Breach of these terms
Illegal or harmful use of our services

12. Governing Law

These terms are governed by the laws of the United States. Any disputes will be resolved through binding arbitration.

13. Changes to Terms

We may update these Terms of Service from time to time. Continued use of our services after changes constitutes acceptance of the new terms.
